“We” and “You”
All references to “us” and similar words such as “we” and “our” (even if not capitalized) mean Dynamhex, Inc., a Delaware corporation. All references to “you” and similar words such as “your” (even if not capitalized) mean the individual using the Platform, and if you are using the Platform on behalf of a business entity, it means both you and that business.
Your Agreement to this Privacy Policy
By using the Platform, you are agreeing to this Privacy Policy. If you are using the Platform on behalf of a business entity, then you represent that you are authorized to use the Platform on behalf of that business and you are agreeing to this Privacy Policy on behalf of both you and that business.
If you do not agree to this Privacy Policy, then you may not use the Platform.
Terms of Service
Our Terms of Service are available atdynmhx.io/terms-of-service(the “Terms of Service”). The Terms of Service applies to your use of the Platform.
Limitations
We will not collect additional categories of Personal Data, or use the Personal Data we do collect, for materially different, unrelated, or incompatible, purposes without providing notice to you

“Personal Data” does not include publicly available information or lawfully obtained, truthful information that is a matter of public concern.As used in this Privacy Policy,“publicly available” means information that is lawfully made available from federal, state, or local government records, or information that we have a reasonable basis to believe is lawfully made available to the general public by you or from widely distributed media; or information made available by a person to whom you have disclosed the information if you have not restricted the information to a specific audience.(“Publicly available” does not mean biometric information collected by us about you without your knowledge.) “Personal Data” also does not include your information that is considered Anonymous Data under this Privacy Policy.

Selling Personal Data
We may sell your Personal Data to third parties, however, you may opt-out of our sale of your Personal Data by contacting us at mailto:ptout@dynamhex.io with enough information about yourself to allow us to identify you and verify you are the person or business you claim to be and enough information about your request to allow us to understand and respond to your request. We will use reasonable efforts to reply to all such valid requests within 30 days of receipt of the request. We do not knowingly sell the Personal Data of users under age 16.
International Transfers
We will not transfer your Personal Data across international borders.
Improvements to the Platform
If you share ideas or suggestions with us regarding improving or modifying the Platform, then we may use all the same without your consent, without providing notice to you, and without providing compensation to you.
Data Retention & Our Right to Delete
We may retain your Personal Data for as long as you maintain an open account in the Platform and for as long as necessary to provide the Platform to you. We may also retain your Personal Data after those periods, but only for purposes of complying with legal processes, to resolve disputes, or as otherwise allowed by applicable law. Please note that we do not have any obligation to store your Personal Data for your benefit of for the benefit of any third party. We may delete all or parts of your Personal Data any time, for any reason, without notice to you, unless otherwise prohibited by applicable law.
Compliance with Legal Process
We may use and share your Personal Data as follows: (a) to comply with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms, (b) to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements, (c)to prosecute and defend a court, arbitration, or similar legal proceeding, (d)with our representatives and advisors, including attorneys and accountants, and (e) if we have a good faith belief that disclosure is necessary to enforce our Terms of Service or any policies referenced in our Terms of Service or to investigate or prevent illegal or immoral actions
Your Rights & Choices
Cookies & Tracking Data
You may restrict our ability to use cookies and certain other types of data files by adjusting the settings on your device or browser. However, please note that if you create such restrictions, all or parts of the Platform may not operate as intended (or at all).
Social Media Account Information
The only way for you to control what information third-party social media platforms share with us is to adjust your settings in those platforms. We disclaim all liability resulting from those platforms’ unauthorized disclosure to us of any information which you requested the platforms not share with us.
Access
You may request information about your Personal Data we collected and how we used that Personal Data in the last 12months. If you make such a request, then we will provide you with the categories of your Personal Data we collected in the last 12 months, along with the categories of any third parties with which we shared or sold that data, and the specific pieces of that data, as well as any other information of which we are required to provide to you by applicable law.
Deletion
You may request that we delete your Personal Data from our systems. We will comply with that request within area son able period, unless we have a legal right to retain that data (for example, to continue providing the Platform to you, or to complete a transaction which you initiated in our systems).
Exercising Your Rights
To exercise your rights described in this Privacy Policy, please contact us using the contact information at the bottom of this Privacy Policy. You must include enough information about yourself to allow us to identify you and verify you are the person or business you claim to be and enough information about your request to allow us to understand and respond to your request. We will use reasonable efforts to reply to all such valid requests within 30days of receipt of the request
Non-Discrimination
We will not discriminate against you for exercising your rights under applicable laws, including the CCPA
Security
We use reasonable efforts to protect your information, especially your personally identifiable information and payment information. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information you transmit to us. Further, it is your responsibility to protect the security of your account credentials
Power to Amend This Privacy Policy
We may amend this Privacy Policy at any time, for any reason, with or without notice to you, and your continued use of the Platform after the amended Privacy Policy is posted on the Platform will constitute your acknowledgment and agreement to the amended Privacy Policy. However, to the extent the amended Privacy Policy materially alters your rights or obligations in this Privacy Policy, the amended Privacy Policy will become effective upon the earlier of (a) your continued use of the Platform with actual knowledge of the amended Privacy Policy, or (b) 30 days after the amended Privacy Policy is posted on the Platform.
